NCSW Consults on Family Laws Reform in Pakistan

The National Commission on the Status of Women (NCSW) recently held a high-level consultative session aimed at reviewing and recommending reforms to several key family laws in Pakistan. This initiative was undertaken at the directive of the Standing Committee of the National Assembly on Gender Mainstreaming, underscoring NCSW’s pivotal role as a statutory body dedicated to protecting women’s rights and promoting gender equality.

The consultative session was presided over by Chairperson NCSW, Ms. Ume Laila Azhar, who emphasized the importance of ensuring that family laws reflect the evolving realities and challenges experienced by women and families across Pakistan. Highlighting the critical nature of this review, Ms. Azhar stated, “As the statutory body is committed to the advancement of women’s rights, NCSW has a duty to approach the review of these laws with great care, sensitivity, and responsibility. This task, assigned by the National Assembly, must consider both the lived experiences of women and the legal framework that governs their lives and rights in family settings.”

The laws under examination included three landmark acts: the Dowry and Bridal Gifts (Restriction) Act of 1976, the West Pakistan Family Courts Act of 1964, and the Dissolution of Muslim Marriages Act of 1939. Discussions focused on analyzing existing challenges, identifying legal gaps, and addressing emerging social and gender-based concerns within these legislative frameworks.

The session brought together relevant stakeholders, including representatives from the Ministry of Human Rights, Ministry of Law and Justice, Ministry of Interior, Ministry of Religious Affairs, legal experts, and senior officials from NCSW. Participants engaged in detailed discussions on the limitations and shortcomings of the current legal framework, exploring potential reforms and policy recommendations to ensure these family laws are responsive, effective, and reflect contemporary societal standards.

Outputs from the consultation will be formally compiled and presented to the Standing Committee of the National Assembly, serving as valuable inputs to guide future legislative reforms. This consultative process highlights NCSW’s commitment to evidence-based policymaking and developing inclusive legislation that upholds justice, dignity, and gender equity.

Through this initiative, NCSW has taken an essential first step towards revising Pakistan’s family laws, aligning them more closely with social changes, and addressing gender concerns faced by families throughout the country.
